Prosecution & defence clash over DPP's efforts to remove Pusey
There was more drama at the corruption trial of Kern Spencer, former Junior Energy Minister in court Monday morning when defence attorneys and senior prosecutors from the Office of the Director of Public Prosecutions (DPP) clashed over the move by DPP Paula Llewellyn to have Senior Magistrate Judith Pusey removed from the trial.
Senior Magistrate Pusey was slated to rule Monday morning on an application by the defence for the case against Mr. Spencer and his former assistant Coleen Wright to be dismissed.
However, Deputy DPP Caroline Haye told the Magistrate that she has a High court order stopping the trial.
The order was granted last week by Mr. Justice Horace Marsh following an application by the DPP for Judicial Review of the Senior Magistrate Pusey's handling of the trial.
Ms Llewellyn has accused Magistrate Pusey of 'apparent bias' in her handling of the trial and wants her disqualified from continuing to preside over the hearing.
But in court Monday morning, Mr. Spencer and Miss Wrights attorneys came to the defence of Senior Magistrate Pusey and made it clear that they were unhappy with the position taken by the DPP.
No one wants to serve documents on Magistrate Pusey – Deputy DPP
Lead defence attorney KD Knight blasted the DPP and said the public will not be fooled by her action to have the Magistrate recuse herself from the trial.
Mr. Knight and Mrs Haye clashed when he insisted that the defence be served with new documents.
However, Mrs. Haye reminded him that the defence was not a party to the new action.
During the exchanges, Senior Magistrate Pusey pointed out to Mrs. Haye that no documents have been served on her to stop the trial.
Mrs. Haye shot back that she has been trying to serve the documents on her since last week without success.
According to the Deputy DPP she cannot find anybody in the court building willing to serve the documents on the Senior Magistrate.
Following the deliberations the trial was set for mention on November 18.
