they cannot fine him unless he is guilty of an offence for which he has been charged. i am not a criminal lawyer but i am not aware of a lesser included charge to the conspiracy to distribute etc etc or even if there were other charges.
i also i do not know (or think for that matter) that the conspiracy charge carries "degrees" .. first degree etc.
he will either be convicted or acquitted, i am not really seeing a middle ground ...
