FOR KNOWLEDGE OF THE ORDINARY PARTNERS, CLUBS, SAD’S AND TOO INTERESTED, IT FOLLOW TRANSCRIBES ITSELF, BY TRANSLATION, THE CONTENT FROM THE CIRCULAR Nº 866 FROM THE FIFA,
ABOUT THE MATTER IN REFERENCE, DATED OF 24 OF SEPTEMBER OF 2003: APPLICATION OF THE BEGINNING FROM THE AUTOMATIC SUSPENSION AFTER AN EXPULSION DURING A GAME OF SOCCER
“After argument deepened of this matter with several members from the family Re-examinar all of the aspects relatives to the beginning from the automatic suspension after an expulsion. To 29 of June of 2003, carried out themselves in Paris a meeting about this matter, that counted on the presence of the President from the FIFA, of David Will, Vice President and President from the Commission for the Legal Matters from the FIFA, of Slim Aloulou, member of the Comité Executive from the FIFA, and of Marcel Mathieu, President from the Commission of Discipline from the FIFA, and from the which they resulted Instituted in the soccer and reiterated in the circular nº 821 of 1 of October from 2002
from the FIFA, any player I expel for the arbitrator stayed, in principle, suspended for the following game, agreement with the nº 4 of the art.º 19º of the Code Discipline from the FIFA (CDF).
To present circular has for objectivo clear everybody the doubts that look to have arisen relativamente to the application of this I begin, giving a reposta unmistakable the questions frequently put:
1. A player I expel during a game of soccer he stayed automatically suspended for the following game (cf. art.º 19º, nº 4 and art.º 39º of the CDF).
2. The resort of an automatic suspension never has effect suspensivo. A player I expel does not be able to, in circumstance some, participate in the following game while awaits the decision of the resort by itself interposto, independently of the motives of the even.
3. The resort from the resultant automatic suspension of an error I manifest of the arbitrator, we will have of the art.º 38º of the CDF (privately error as regards the identity of the player involved in the incident that drove to the expulsion), is able to and immediately should be admitted or rejected, of form it permit that the player I expel innapropriatly be able to, if will go case of that, play in the following game.
4. The instance discipline can take an immediate
decision in what concerns a such resort, since the error I manifest is able to, by its nature, immediately to be established. If it subsist any doubt, such signifies that the error of arbitration is not manifested and the resort is able to, therefore, immediately to be rejected. We request to the federações national members from the FIFA that adoptem the predicted legal instruments in the Code Discipline from the FIFA (art.º 134º and 140º of the CDF) of form it they will be able to take immediate decisions relativamente to those resorts: authorize the instance discipline to efectuar a conference telefónica or attribute to a judge only
competence to deliberate.
5. If the automatic suspension not puder to be fulfilled in a national or continental competition of clubs, falls to the competent authorities decide itself the suspension must or do not travel for another one competition.
6. The beginning from the automatic suspension should be applied from the same form, be which will go the absence cometida by the player. However, in privately grave case of absence, the competent authority is able to estender the imposed sanction to everybody the competitions organized under its jurisdiction, of way it avoid that a player that have cometido such absence can continue to
playing in other competitions.”
