My guess is whereas Hodge was preoccupied with his phone,the off duty cop saw him and never took his eyes off him.Now this raises the possibility that the bump was not accidental.
We know why Hodge was preoccupied, why wasn't the bump prevented by the off duty officer? -

I hope the court fines the police department for wasting its time and taxpayers' money!
