i can see where this would be okay in certain instances...not in this one though...let's say you are a cop & get into a shootout with a suspect...you kill the suspect but also kill an innocent bystander in the process...nothing wrong with suing the dead suspects estate...

so if a man a do an armed robbery...you are called to the scene as a police officer...he engages you in a shootout...you shoot & kill him & in the process kill an innocent bystander...who is to blame for the death of the innocent bystander?
