  • Will Kartel verdict can be easiliy tossed out

The vote was 10 guilty to 1 not guilty. The 1 not guilty tried to bribe the jury foreman. She said no and reported it. That jury then change his vote to guilty and we have 11 - 0 guilty? Was he pressured to change his vote?

While the meeting was underway, whispers echoed around the court corridors of the bribery attempt. Sources at the court revealed that word had reached Justice Campbell that the juror had approached the foreman of the jury and offered her close to $500,000 to return a not guilty verdict. His offer was rejected and a report was filed. When the jury returned from the jury room to announce the verdict, the accused juror could be seen acting nervously and breathed heavily before taking his seat.
The same type of thinking that created a problem cannot be used to solve the problem.

    11-0? Wasn't it 10-1?

Jamaican courts mussi different and it is not a requirement to have 10 and not 11 deliberate. If there is juror misconduct, that person is typically dismissed and an alternate juror is added for deliberations. Some criminal trials typically have 3 alternates.

No Time. The 1 not guilty was not the one who was trying to bribe, that person was excluded. They started out with 12 jurors.

Jamaican laws were changed some years ago so that a unanimous vote is not required in certain trials, 9-3 is good enough for conviction. However, the deliberation has to be for a minimum of 2 hours if it is not unanimous. That is why they were sent back when they came to the verdict too quickly.

He couldn't have been excluded...12 jurors started...one was given permission to leave the jury pool...that left 11...decision was 10-1 so the juror charged with bribery was a part of the decision...

Oh OK, didn't know one was already out. So the briber was the one not guilty vote then, they let him vote then arrested him after the trial?

Anyway , a unanimous vote was not required for conviction so his vote was not a decider.
