1. .... not a presumptive tenant and not by non enforcement. what is "abandonment de jure" you mean the formal agreement? how is that "abandonment"? the issue of abandonment, does not arise as there are no competing rights to consider given the formal nature of the 1961 agreement, assuming that to be true of course.

There are tenant rights and landlord rights in any real estate lease agreement.
Some rights would be explicitly stated...others may apply by common law or practice
If a tenant ceases to occupy a property in any fashion for decades and the landlord in turn publicly changes the use of the property via a legal instrument without protest by the presumptive tenant.... a reasonable person can conclude that constitutes abandonment in fact.
And yes... That's merely my opinion

That's an opinion. I'm sure if it came to litigation the US opinion would be whatever best serves its purpose
I'm also sure that if Jamaica were well advised their position would be one of abandonment
