no but the man is a charged murderer and Don and if the state can't win this case we are in trouble. How are they going to take the property of Dons and Drug dealers?

Why did the defense wait until now to pursue it?

Its not about following the US constitution, its about enacting a system of governance that meets your specific needs as a nation , our system is antiquated and derived from our masters who forged through their history of wars both internal and external to arrive at their existence , granted some might be of use to us ,others cripple our industry to grow.

South American nations rewrite their constitution dynamically, almost every nation in South America has rewritten its constitution in its history , some 2 to 3 times e.g Brazil & Venezuela. To meets its industrious needs, we sit on ours as if its damm near perfect.Cuba rewrote its in the 60s and I have no doubt they will rewrite again in the next 20 years and we wont .

Caribbean nations are always slow to react to a rapidly changing world especially when it comes to the constitution which is considered sacrosanct...on paper mostly...since these same Politicians and Senators (almost the same) will circumnavigate it when they see fit...or tweak to facilitate their own ends.

Changing will mean new rules for all.

I hope no one believes I am in favour of a US constitution for Jamaica , but I see obvious changes that would make us more dynamic , in how accountable we can be to our stake holders(citizens) by borrowing some of its best properties .

          1) a more open system where anyone can run for P.M not dependent on a party.

          2) Separating our Judicial system from the political (checks and balances in the appointee process and removal process )

3)Empowering all investigative branches to fight corruption

If they can write that into our westminister style of governance fine , if not BUN IT OUT !

He was charged for two murders and not in the capacity of a don(extortionist, drug kingpin etc) hence the evidence sought was confined to the charge...
The defense waiting has everything to do with increasing it chance of a favorable outcome, didn't all this occurred under the PNP leadership(from start to finish)?
The AG hands are not tied,in fact the discussion should be demanding that the AG target the funds...

did you read the complete article??? The defense by the former AG when they withdrew the petition?

"However, the court documents showed that unlike prosecutors in 2008, who demanded that Phipps prove how he earned the cash, the AGD raised minimal challenge to Phipps' claim."

Did you read that? What is the legitimate business? Did he pay any taxes???

It is all a BIG deception, with the Queen initiatives still figuring, all models if not direct copies of her format bears semblance of that format.
Only the Democrats and Republicans are really considered for leadership, the independence parties are isolated in presidential debates.
The judicial system of both nations are similar, and subject to circumvention much the same way.The Patriot Act was written before the mass killings of new yorkers occurred...
The investigation of the Drug activities surrounding Barry Seal forced a State Police officer and AG to haul a$$ out of town because of where it pointed to....,some people in high places....

The real surprise is his bank account is much more hefty, when was the last time we heard of any of the dons bank account figuring,? We heard about the US40,000 found in the Presidential Clique Office and not about the millions in Dudus bank account.
Look, in hindsight it clearly was a tactical move by his defense team, maybe if the the then AG initiated steps to make the confiscation official we would not be having this discussion today.
Yes the money is tainted, when Skeng rode up on a bicycle and handed Micheal a bag fill with money(it was later returned)no one even thought about the legitimacy...
Again, the onus should be what will the AG will now do...
I was privy to the bank account balance of a Jim Brown(was very close to a female from a bank in front of Beeckles restaurant(halfway tree),he was noticeably wealthy but she told me he profited from the many Government contracts he received.
My guess is Zeeks is known not to be poor.

my problem is not using the law with teeth. We are in a time now where each and everyone should have to prove their earnings and Dons gain should be taken away.

It becomes complicated because of Govt dealings with those dons, Danhai williams is an example.
Zeek is worth more than what was seized at his home, believe me it maybe easier to attribute the funds seized to his penchant for foreign currencies(UK,US,Canadian)than justification for having that money.
His dealings with Govt justified that wealth, and besides a detail audit would only create scrutiny regarding the Govt handling of contracts awarded by circumventing the mandated bidding process.

The problem is these elements continue to benefit regardless of the laws. Where will it end?

It will never end as long as we have both parties figuring in our future. Both by being at the helm from the get go have been compromised insomuch that they are incorrigible.
JP has to redefine the role of politicians, there are mere servants, and have not delivered any service that can be appreciated.
If there are philosophical differences between the PNP and Michael Manley then the PNP has moved in the direction of the JLP.
The history of politics in Jamaica is badly soiled,no doubt Seaga has gravitated to being a son of Jamaica,a claim he was not entitled to while he was in power.
I expect this new found love for Jamaica to transcend to some ugly disclosures by the former party leader upon his destiny with after life. You will be surprised by the jaw dropping revelations, that will help in placing things into perspective, the beginning of JP making informed decisions.
The hands of the former leaders of the PNP are filthy too.It is amazing how Jamaica survived it all,it signifies the resilience of a people.

why you put in Seaga only? PSM is the PM, she knows alot, Bruce knows a lot and so do Trevor Monroe and alot of people you see masking as saint and statesmen. No doubt Seaga knows a lot but he is not alone.
