St Thomas cop pointed gun at his colleague
    Wednesday, September 19, 2012

KINGSTON, Jamaica – Corporal Dwayne Smart charged with murder of a pregnant woman in St Thomas was refused bail this morning in the Home Circuit Court.

Bail was denied based on the circumstances of the case, the presiding judge said.

The court was told this morning that Smart pointed his gun at a colleague who tried restraining him after the woman was shot in Yallahs Square on September 1.

According to the colleague’s statement he cautioned Smart prior to the shooting about the way he was treating the pregnant woman.

Smart told the court that he was attacked by relatives of the pregnant woman and other people in the crowd at Yallahs. He said that his uniform was torn in the process.

Smart appeared in court for the first time Monday since being charged with murder for the shooting death of eight-month pregnant St Thomas resident Kay-Ann Lamont.

He returned to court today when his attorney made bail application on his behalf.

Smart is scheduled to return to court on October 12.

He should not be allowed to determine his own destiny, but I fear he could get off because of our justice system that seems to give so much to defence lawyers.

Some people had a problem with me saying his colleagues should have taken him down, yes, shoot him!, when he began shooting at the sisters. They say that was too harsh. Even Dionne Jackson Miller did not want to entertain that idea.

I wonder how she feels now, hearing that the eediat cop turned his gun on his colleagues!

Of course, his colleague should have taken him down - in the circumstances that was the only way to pacify him.

It's difficult for a cop to shoot a cop and the shooting was over in seconds. Cops don't like to pull weapons on each other but I heard of one case in California where police shot another police in full uniform in the same department while trying to arrest him.
The same type of thinking that created a problem cannot be used to solve the problem.
