    DPP Rules St. Thomas Cop To Be Charged

    Kay-Ann Lamont , who was shot and killed by a policeman on Saturday in St. Thomas- Contributed.
    The Office of the Director of Public Prosecutions (DPP) has ruled that four charges be laid against police corporal, Dwayne Smart, who allegedly shot dead the 27-year-old pregnant woman in St. Thomas on Saturday.

    Smart will be charged with murder, wounding with intent, assault and illegal possession of firearm.

    The DPP’s recommendation follows the completion of a report into the incident by the Independent Commission of investigation (INDECOM) into the Yallahs, shooting.

    Kay-Ann Lamont was shot twice in her head on Saturday during an altercation with the corporal, after he attempted to arrest her for using indecent language.
    Lamont was eight months pregnant.

    Her sister, Novia, was injured and had to be hospitalised.

    Yesterday, there was a standoff between residents and the police in Yallahs as the community members demanded that the policeman be turned over to them.

    The accused corporal lives in the Yallahs community with his wife and two children.

    The policeman has been in custody pending the completion of INDECOM’s investigation.

    In the meantime, the DPP said in light of the high publicity in the case, a voluntarily bill of indictment is to be entered to have the matter proceed directly to the Home Circuit Court.

    This means that no preliminary enquiry will be held at the St. Thomas Resident Magistrate’s Court.

    The DPP notes that the Michaelmas Term of the Home Circuit Court opens on September 17.

    Can't help but wonder if the DPP herself, Paula Llewellyn, would have ruled so quickly, or acted to have the matter proceed directly to the Home Circuit Court.

        I am happy that they charged him so quickly and is speeding up the process. Lets hope that we get a quick conviction. I doubt that they will give a servant of the crown a death sentence.

        I find it interesting that they charged the him for illegal possession of a firearm. My guess is that the firearm is a licensed firearm (not a police issue firearm.) Once you pull a licensed firearm for the wrong reason then you are in illegal possession of the firearm. It seems that he wanted to arrest her for cursing so he put himself 'on duty.' Strickly speaking A JCF/ISCF police officer is never really 'off duty' but that is a complicated issue. If he is on duty then does the firearm act protect him from the illegal possession charge? I would love to hear how his lawyer defend the illegal possession charge.
        The same type of thinking that created a problem cannot be used to solve the problem.

                Did not know he was here. I know him from cadet days. He was a cadet at St Georges.
