Complainant Cannot Be Found, Cop Freed

A POLICEMAN who was charged with causing grievous bodily harm with intent has been freed because the complainant cannot be found.
The Crown offered no evidence in the case after the court was told that the investigating officer had made intensive search for the complainant, but without success. The investigating officer was questioned in the Home Circuit Court as to the attempts he made to to find the complainant.
Supreme Court judge Sarah Thompson James directed the jury to return a formal verdict of not guilty, freeing constable Albert Nembhard.
Attorney-at-law Oswest Senior Smith had argued in court that the case against his client Nembhard had been dragging on for too long and the complainant had never attended court.
Nembhard was accused of using his firearm to hit Shawn Hylton, a taxi driver, in the left eye. Hylton is blind in the left eye as a result of the injury.
The allegations were that in June 2006 Nembhard was in the process of seizing Hylton's motor car downtown Kingston when a dispute developed.
It was further alleged that Nembhard grabbed Hylton and then used his service revolver to hit him in the face. A report was made to the police and Nembhard was arrested and charged.
