The Crown led evidence that on April 28, 2010, the complainant was taken to his house by the accused. He reportedly took off the child's clothing and gyrated on him.
The child started to cry and he was given marbles by the accused who threatened him and told him not to talk. The frightened child, however, related his ordeal to his mother.
A subsequent report was made to the Bog Walk police and an investigation was launched.
The man was subsequently arrested and charged with indecent assault.
During his sentencing, a number of persons, including relatives of the complainant, asked for a non-custodial sentence.
