  • Jamaican Marriage Trivia

    Saw this online....

In Jamaica a couple got married, wife emigrated shortly after. The marriage had no activity, and both couple went off into other relationships, had children out of the marriage with other partners. Husband living common-law for over 16 yrs and wife return to Jamaica with 3 outside children. Husband dies what claim does common-law and his children have to his asset. Can this lady and her outside children put claim to what is rightfully my siblings, stepmother and I? Please post on your wall for dialogue. Thank you.

They can't be common law if they didn't live together...

True, it is not a common-law marriage if they do not live together.

what do you mean "no activity"? was the marriage consummated? if it was then there can be no common law marriage with anyone else and there is a proper marriage in place.

Yeah, I remember the Bob Marley issue. They will have to fight it out in the courts?

              Why?
...why can't they sit at the table and work it out?

amaica recogises the rights of children born out of wedlock to the husband as children with the same rights. Additionally (this part is absurd) children born to the wife while she remains married are presumed to be children of the marriage, this rebuttable though and can be done so easily in this case.

Yes, and those are his kids. I was around for the passing of the status of children's act.

Kids born ah farrin when him deh ah Jamaica would be a strtch to prove. Plus most likely dem real father claims them.
