Let us assume the S6 driver felt he was a victim of an attempted carjacking and stands to benefit from the nexus between the taxi driver and the KC six former that was killed.
The shooter only defense is he was facing deadly force,the fact that there is no evidence of a second firearm,and the shooter,gunblazing,pursued the taxi(likely when the victim was killed)suggest the S6 driver no longer felt threatened if he was ever to begin with.
His actions thereafter was not that of a victim but that of a perpetrator of a crime.

As I see it the Taximan's life is in danger. At present he is staying home. How long can he afford to stay home? He has two daughters that he must support. When he ventures out to make a living; his life can be cut short.

If he is given asylum in the US then the shooter walks (as the taximan is the key in terms of evidence). The gun is already lost or stolen hence no ballistic test to match bullets.
