    Hay-Webster served - Hearing of dual citizenship case set for Feb 17

    PEOPLE'S National Party (PNP) MP Sharon Hay-Webster was yesterday served with legal documents challenging her legitimacy in Parliament over her alleged holding of United States citizenship.
    The matter is set for a first hearing in the Supreme Court on February 17 when Hay-Webster is expected to contest the action.

    The petition to oust the Opposition MP was brought by Devon McDaniel, the Jamaica Labour Party candidate Hay-Webster defeated in the September 3, 2007 general election for the South Central St Catherine constituency.

    McDaniel's documents were filed last year on the heels of the JLP's Shahine Robinson being disqualified by the Supreme Court as MP for the North East St Ann constituency because of her sworn allegiance to the United States. Robinson has since returned to Parliament after winning the seat in a by-election on December 20 last year.

    McDaniel is seeking several declarations from the court, chief among them that Hay-Webster was the holder of United States citizenship on nomination day in August 2007 and therefore was not duly nominated to contest the election, and that the South Central St Catherine seat be declared vacant.

    In the document filed by attorney Alexander Williams of the law firm Usim, Williams & Company, McDaniel quoted a newspaper report which stated that Hay-Webster was born in the United States in 1961 but only obtained that country's passport in the 1980s after moving to Jamaica.

    "The defendant has in fact, on more than one occasion, publicly admitted that she is the holder of a United States passport...," said McDaniel's affidavit in support of his court action.
