DPP's application dismissed

Supreme Court Judge Justice Lloyd Hibbert has dismissed an application from the Director of Public Prosecution (DPP) Paula Llewellyn seeking leave to the Judicial Review Court to have Senior Resident Magistrate Judith Pusey removed from the Cuban light bulb trial.
In her application, Llewellyn had accused Pusey of demonstrating apparent bias in the conduct of the case which falls within the category of disqualification by conduct.
But, after hearing submissions today, Justice Hibbert said the application and evidence presented was premature and ill-founded.
She had already obtained an order from the Supreme Court barring the senior resident magistrate from proceeding with the trial.
Former junior energy minister Kern Spencer and his personal assistant Coleen Wright are before the court on fraud and corruption-related charges arising from the implementation of the Cuban light bulb programme.
