Charges are to be laid against three members of the security forces on Monday arising from the 2008 controversial shooting deaths of five men in Tivoli Gardens in West Kingston.
Two members of the Jamaica Defence Force (JDF) and a member of the Jamaica Constabulary Force are to be charged with murder and aiding and abetting.
A coroner's jury, which inquired into the shooting, recommended last month that the JDF soldiers and the policeman be charged.
However, RJR News has received information that the Director of Public Prosecutions (DPP) is struggling to find the evidence to prosecute the case.
A senior prosecutor told RJR News that there is a new twist to the case and the DPP's position on the matter will be outlined on Monday before presiding judge, Justice Lloyd Hibbert.
The prosecutor declined to state whether or not the DPP will be moving forward with the case.
On January 13, 2008, police and military personnel entered Tivoli Gardens in search of the leader of the Stone Crusher gang, who was reportedly hiding in the area.
This led to a gun battle between members of the security forces and gunmen in a house.
Following the shooting five men were fatally shot and a JDF soldier and policeman were shot and injured.
