20 suspects to have their assets seized

By KIMMO MATTHEWS, Observer staff reporter matthewsk@jamaicaobserver.com

    Thursday, June 24, 2010

COMMISSIONER of Police Owen Ellington said the police have identified at least 20 persons of interest whose assets they will be moving to seize.

Ellington said the police were carrying out investigations about the source of the assets of these persons, who are people of influence within their communities.

He was speaking at a PSOJ Chairman’s Club Forum at the Hilton Kingston Hotel this morning.

Ellington said preparations were being made today to serve one such person with papers.

It is expected that the persons will be prosecuted under the Proceeds of Crime Act, which gives the State power to seize property and other assets obtained through criminal means.

Well them must charge them for something right?

    Tax evasion, laundering, something?

You can't just seize people assets and not charge them?

this is one of my frustrations with the jamaican prosecutors... there are so many instances where they have fallen short... no wonder the criminals are so emboldened...

in some other countries, prosecutors would file so many charges, criminals would be broke paying lawyers and still end up doing big time...

i agree with you, the state just cannot confiscate property without first charging a person for some crime... the crime or criminal activity has to come first and be proven in a court of law... in the interim, i suspect assets can be frozen at the time of the charges, just not confiscated...

...so paying of required taxes is not a lawful requirement?
Isn't failure to do same not punishable by fines and or jail time?

So why not assessments made such that entire assets can be frozen pending full disclosure of how the funds were come by.

...if the person cannot explain to the satisfaction of the relevant authorities how the funds were obtained...and remember funds on hand is not the whole story as funds it can be reasonably assumed by 'paper trail' - travels, vacations, real assets, past and current standard of living, past financial transaction, etc. - form a part of any assessment...then...????

Superpowers have a way of not following through on promises when they get what they want. Ask the Kurds.

We betta plan to do this ourselves.

Boss, truss mi locals can't arrest some of these criminals (in high places) that bring death and destruction on the people of Ja. The FEDs will have to do it. Not to worry "they" have already slipped; so now it's a matter of national security to the US.

"They" can't fly below the radr anymore. The treaty is but one step, the security initiative will give a proper house cleaning. Afterwards jakans can return to working hard and see the reward of their work (small though it be) Ja will no longer be place for "them" to hide.

Yep. The jackass politicians think that when loads of illicit dollars flood the island it is good for the country. Jamaica is not a high producing nation, so when you have too much money chsaing too few goods and services you end up with inflation, or near hyperinflation in Ja's case. The poor man gets screwed because when the fisherman catches his fish why would he sell it aat an affordable price when Mr. Big drug dealer is around the corner waiting to but the entire catch at exorbitant prices.

I have a friend in Portland who is a chef and had a restaurant many years ago. He lost his business because the rent got to be sky high, and he said the current rental rates now are so high that he has no hope of going back into business. The rates he told me are like New York city rates. Again that is no problem because the drug dealer with lots of cheap money will rent it. This goes on and on and on.
