"Based on a 1992 US Supreme Court ruling, the US may kidnap accused persons from foreign countries to stand trial in the United States, even if there exists an extradition treaty with the other country.
According to attorney, Professor David Rowe, there is no clause in the existing extradition treaty between Jamaica and the US to prevent kidnapping of an accused person wanted in the US.
The 1992 case involves the kidnapping of Alvarez Machain from his home in Mexico by US Drug Enforcement Agents in 1992. He was flown to Texas, where he was arrested for his participation in the kidnapping and murder of a DEA agent and his pilot."
