  • Sunday Herald principals to be sentenced for tax evasion

The operators of the Sunday Herald Newspaper, New Media Communications and its Principal Desmond Richards are to return to the Sutton Street Tax Court on April 29 for sentencing in criminal matters relating to the failure to pay over taxes.

The operators returned to the tax court Monday for breaches of the Income Tax, Education Tax, General Consumption Tax (GCT) and Company Tax Acts.
According to a release from the Tax Administration Department the ongoing tax matters were brought before the Sutton Street Court after all attempts to arrive at a settlement agreement failed.
At Monday's hearing, the attorneys for New Media requested time to make suitable payment arrangements.

However this was denied by Resident Magistrate Parkin, who indicated that the taxpayer had been given more than enough time by the Inland Revenue Department to do so.
The court then ordered that the outstanding principal sums of nearly $36 million for GCT and $58,000 for Company Tax be paid in six monthly installments.

This order takes effect on April 29, 2010.
The Tax Department says if the taxpayer defaults on the court order, more drastic action will be taken.
In the criminal matters relating to PAYE and Education Tax, the company and the director were each summoned to answer to 136 offences brought before the court by the tax authorities, resulting from failure to pay Income Tax and Education Tax for the period 2003-2008.
These matters are scheduled for sentencing on April 29.

If they deal with all the companies in like manner...tons of companies fold instantly...and unemployed workers fill the streets. Not paying as statutory taxes should be, is a big thing in JA...

Cho! ...government and quasi-government departments paying those mandatory taxes as required?
      Joke ting, dat!

However, if they had been focusing on getting tax evaders to pay up from before then they wouldn't have had to raise taxes to extortionist levels.

This is the right move. If they couple it with a lowering of the overall taxes then it would work.

As for companies folding....that can't be right. The Sunday Herald was basically owing (according to the article) J$7million a year for 5 years. Now who really believe that the Sunday Herald would fold if it paid that much every year? Surely since taxes are calculated as a portion of your revenue, then they must have been earning substantially more each year. If they let the taxes build up to the point where paying them off at one time cripple dem, then more fool dem and dem deserve to fold. It would neva work so in odda places.

Give onto Caesar...that goes without saying. But we, the Anti-Bruce crew, are just wondering if they were singled out because they have been a thorn in the side of corruption. In the same vein, one has to wonder which organisations have been given a bligh or just simply not investigated, simply because they are part of the Bring Down Jamaica crew.
