THE 12-member jury in the murder trial of People's National Party (PNP) activist Milton 'Tony' Welsh was yesterday unable to reach a verdict at the Kingston Home Circuit Court, following five hours of deliberation.
After the jury was discharged, attorney K D Knight rose to make bail application for Welsh when Justice Marjorie Cole-Smith advised him to wait until Friday as her "mind was not in the right place" and that she had not had lunch.
Welsh, the reputed Brandon Hill area leader, had been on trial since October 9 for the stabbing death of 21-year-old Damion Hussey of Golden Spring, St Andrew on January 15.
Hussey, who was in his yard, was accused of stoning a bus with supporters of Dr Peter Phillips while it was travelling through Golden Spring following the launch of Phillips' presidential campaign for leadership of the ruling PNP.
Fifteen days later after the incident Welsh turned himself in to the police, but refused to participate in an identification parade. He was subsequently slapped with the capital charge after a "confrontation identification parade" was held where two witnesses were taken to his prison cell and pointed him out as the man who allegedly stabbed Hussey in the chest several times.
During the trial, Hussey's aunt, Elaine Gooden, tearfully testified how Welsh slashed to death her nephew, while other men pummelled him as he begged for his life.
The defence, however, charged that the accused was not on the scene at the time of the incident. In an unsworn statement from the dock last Thursday, Welsh said that he went to Bull Bay with his daughter after leaving Phillips' campaign launch at the National Arena.

    RE: Jamaican Justice!

2 eye witnesses fingered the defendant as the killer, yet there is a hung jury? From I heard who was the defending attorney, I was expecting something like this.

I can bet the poppyshows round here naah guh see no injustice here.
