    THE bail violation charges against reputed Klansman gang leader Tesha Miller were dropped when he appeared in the Half-Way-Tree Resident Magistrate's Court yesterday.
    However, his troubles are not yet at an end as he was remanded in custody, as he is facing trial for the alleged gun murders of four persons in St Catherine. Miller will remain in police custody until July 23 when a bail application is scheduled to be made by his attorney, Everton Bird.
    The murder trial is expected to take place at the Home Circuit Court in Kingston, where Miller was transferred yesterday under heavy military and police guard.
    Yesterday, a small but quiet group of supporters congregated outside the Supreme Court, as they awaited news about Miller, whose arrest last Friday for bail violations set off a fiery demonstration in Spanish Town, where the Klansman gang is based.
    The 27-year-old Miller is facing trial for the triple murder of Oraine Jackson, Jeffery Johnson, and Nicole Allen in Breaton, St Catherine on January 14, 2005. Another accused, Rohan Brown, is scheduled to be tried along with Miller in this matter. Two other persons were also injured in the shooting.
    In addition, Miller and another man, whose name is being withheld pending his arrest, are to be tried for the April 7, 2004 murder of Robert Haughton on St John's Road in Spanish Town.
    Meanwhile, a man said to be a key player in the Klansman gang was yesterday detained and questioned when he showed up at the court to support Miller.
    The man was picked up by the police and taken to the Spanish Town Police Station where he was questioned for several hours and processed before being released.
    Sources said the police received information that he would be at court and a directive was given for his detention.



    Jamaica's justice system is a real joke. I wonder how long before Tesha is out on bail?
    The same type of thinking that created a problem cannot be used to solve the problem.

      A website needs to be established that will document the pathetic judicial system, human rights abuses & political corruption in Ja. We all know the media lacks the moral courage to do any investigative journalism in Ja.

            From RadioJAmaica....so which one of these reports are right or are they saying the samething....Is reporing really that diificult? Seems like rocket science in JA

            The bail bond of reputed leader of the Klansman Gang Tesha Miller has been officially revoked and he is to remain behind bars until his trial on multiple counts of murder and shooting.

            Government prosecutors entered a nolle prosequi on Thursday and had Miller's case removed from the Gun Court Division of the Half-Way-Tree Criminal Court to the Home Circuit Court in downtown, Kingston.

            This did not go down well with defence attorney Everton Bird who objected strongly.

            Mr. Bird lashed out at the prosecutors arguing that they could have applied for the voluntary bill on July 31, when Miller was scheduled to return to court to answer the substantive charges.

            Thursday was not a good day for Mr. Bird as earlier in the proceedings the presiding magistrate in the Gun Court at Half-Way-Tree also rejected his argument that she did not have the jurisdiction to determine whether Miller had violated the conditions of his bail.

            The magistrate, who had reserved her decision Tuesday, told Mr. Bird that she had the jurisdiction under the Gun Court Act to make a determination in the matter.

            Mr. Bird then urged the magistrate not to entertain the prosecution's application for a nolle prosequi.

            He also questioned the actions of the Director of Public Prosecutions (DPP).

            This led to a verbal clash between Mr. Bird and the lead prosecutor who declared that the constitution gives the DPP the power to discontinue a case at anytime and anywhere.

            Later when Miller appeared in the Home Circuit Court under heavy police/military guard he was remanded until July 23 when Mr. Bird will again re-apply for bail.

            Miller, who is charged with a total of four counts of murder, faces the death penalty if convicted for the January 14, 2005 gun-slaying of three persons along Cresser Lane in Braeton, St. Catherine.

            He is also charged in connection with the April 7, 2004 murder of Robert Haughton.

            And the police will not be taking any legal action against Miller who was found in possession of a phone while he was in custody.

            The police had sought legal advice from the Director of Public Prosecutions on the matter.

            However, sources told the RJR News Centre that based on the advice of the DPP the law is not really clear whether Miller can be charged for being in possession of the mobile phone.

            Miller was allegedly found with the phone hidden in his rectum in a cell at the Horizon Remand Centre on Spanish Town Road on the weekend.

            The police were reportedly alerted that Miller was in possession of a phone when they intercepted calls coming from the phone.

            He was reportedly using the phone to issue orders to members of the gang.

            RJR News has been informed that checks are also being done on the calls made from the phone while Miller was in custody.

              Another member of the Klansman Gang has been taken into custody.

              The suspect who was being sought by the Spanish Town Police for questioning in connection with a case of murder was nabbed outside the Half-Way-Tree Courthouse on Wednesday morning.

              Undercover policemen who were stationed there reportedly spotted the suspect and took him into custody.

              The police have promised that they will be coming down hard on members of the Spanish Town-based criminal gang which has threatened to disrupt operations in the old capital until their leader is released.

              The police have since increased their presence in the town and areas frequented by members of the gang.

              The Klansman gang has drawn increased attention from the Police High Command following the recent gun-slaying of the Chairman of the Jamaica Urban Transit Company, Douglas Chambers.

              Mr. Chambers was killed in an area in Twickenham Park dominated by the gang.

                not really......it could very be that they decided that it would a waste of time and resources to pursue that when his murder trial is set to get underway soon.

                    I am confused as to why they didn't just wait till July 21st or whatever? Was the plan to put him before the judge so they could get the trial moved to Kingston?

                          i would put him up there in terms of a criminal law practitioner ...... he also cut one or 2 chune back in the day...... his costs i couldn't tell yuh.....

                            Having the LEADER of a notorius gang in custody should yield lots and lots of intelligence.

                            This should be the end of the Klansman gang!!!!

                            I support water-boarding...etc...etc...
