The Opposition People's National Party (PNP) is warning that it will resist any attempt by the Public Service Commission (PSC) to make another recommendation for the position of Solicitor General.
RJR News reported on Tuesday morning that the post is due to be advertised within the next two weeks.
Before members of the previous Public Service Commission were dismissed, they had recommended that the Governor General appoint Stephen Vasciannie as Solicitor General.
The appointment has not been made due to the government's opposition.
PNP spokesman on Justice A.J. Nicholson says that if the Commission begins to look for new applicants, the Opposition will have to consider its next move.
"We the opposition would have to consider our position whether to recognize any appointment that is made to this commission. Here we arrive at an approach at the Vale Royal talks as to how the commission is to be appointed," said Mr. Nicholson.
"Now the Prime Minister puts four to five persons there who are his direct selectees and these persons are going to make a recommendation to the Governor General...it is really a recommendation to the Prime Minister because the Prime Minister has to sign off on it. So the Prime Minister is going to making appointments to the Public Service Commission and own the Public Service. That can't work, we have to consider whether we going back to court,"
Mr. Nicholson says that by not following the recommendation which had been made by the previous Public Service Commission, the Governor General is continuing to breach the constitution.
"The governor general in that respect is and continues to be in breach of the constitution because the constitution does not empower anyone, any citizen of Jamaica to direct him, including the Prime Minister as to what to do once the recommendation comes from the Public Service Commission," he said.
Section 125 of the constitution states that the power to make appointments to public offices is vested in the Governor General acting on the advice of the Public Service Commission.
