Dr. Paul Wright and JADCOshould be brought up on charges

Both are guilty of besmirching our athletes reputation and ending careers. Dr. Wright, who, as JADCO's Chief Doping Control Officer, has been the foremost in the press crucifying our athletes. His credentials were brought into question during the Veronica Campbell-Brown case and now the facts are proving that under his watch, proper procedures for handling samples were not being enforced. When challenged, he lied about non-compliance procedures were adopted with WADA's blessings. Collecting p!ss is not brain surgery. Allison Randall and Travis Smikle were also tested positive for the same drug. Who is to tell that their samples were not also contaminated due to improper handling practices. They will never get a chance to defend themselves or clear their names. This drug is found in Hypertension medications. Every single Jamaican knows someone or has some family member who takes "presha" pills. Dr. Rachel Irving wrote an article in the Gleaner stating how easy banned substances can be transferred. This theory is being supported by the CAS's "reputable" foreign doctor. I think of Dominique Blake and Steve Mullings who I was quick to chastise. They could have been victims to JADCO's and Dr. Paul Wright's incompetence. The trust factor in JADCO is lost. WADA officials came to Jamaica twice and gave us the green light that everything was "corposetick". Ann Shirley ran to the international press saying we weren't doing enough testing, but we could be doing a million tests per month, if the proper procedures are not adhered to to preserve the integrity of those tests, then it amounts to naught. These are the questions and the issues that our press should be taking up and going hard at these officials instead being lackeys.

Then you have the JADCO disciplinary committee who sits on their high horses and hand down career threatening judgments in the face of hard evidence of improper testing procedures to protect their own. How many careers are they going to continue to destroy while Jamaica's reputation sinks further?

88. The Athlete submits that the JADCO DCOs were required to comply with certain

fundamental procedural safeguards prescribed by the IST and the 2011 Regulations.

Those safeguards are an essential counterbalance to the imposition of strict liability

for ingestion of prohibited substances. They are specifically designed to protect the

integrity of samples obtained during mandatory drug testing. In the present case the

JAAA manifestly, knowingly and systematically failed to adhere to those

fundamental safeguards. The JAAA’s failures, which went to the very purpose of

the IST, made it impossible to guarantee the integrity of the sample collected from

the Athlete. The Athlete submits that the results of any analysis conducted on a

sample obtained in fundamental violation of the IST must be declared inadmissible

and invalid. If the Panel were to find that the violation does not matter, then it

would effectively create a double standard where athletes are bound to follow rules

but governing bodies and doping enforcement agencies are not.

114. Furthermore, in considering the possible explanations for the HCT presence in the

Athlete’s sample, Professor Sever attached particular significance to the statistical

evidence. He noted that of the 100 athletes who were tested at the Stadium in May

and June 2013, three had tested positive for HCT. Of those three, it was known that

two were ‘partial sample’ cases. Of the remaining 97 samples that tested negative

for HCT, it was unknown how many (if any) involved a partial collection. Professor

Sever said he would regard the high number of positive HCT results following

partial collections as potentially ‘significant’ and that the correlation would ‘surely

focus your mind’ on the possibility of HCT contamination occurring in the doping

control room. In his view it was ‘possible…but unlikely’ that the three positive

samples from the same venue were simply a coincidence. Instead, the concurrence

of the positive samples was suggestive of a common environmental cause.

Seems to me all 'adverse analytical findings'

under the set of circumstances described should be set aside/dismissed and any suspensions meted out withdrawn and the athletes have such penalties removed from their records.

The athletes should not even have to appeal.
