Claude Davis will have his work permit case heard by the Home Office appeals committee on Wednesday.
Davis is waiting for the permit to complete his £3m switch from Sheffield United.
The Jamaican defender has not played in 75 per cent of his country's international matches in the past two years - the criteria for securing a permit.
But the Rams say there are special reasons why he has not figured for his national team, with injuries keeping the defender sidelined for a spell.
Derby say they have the documentation to back their case and manager Billy Davies and chief executive Trevor Birch will attend the hearing in Sheffield next week.
Davis has trained with the Rams during their training camp in Italy this week but has been ineligible for their pre-season games so far.
Rams boss Davies said: "Claude has just been getting on with training and he has trained well. I think he will be a great asset for the club."
Davis has had two permits granted in the past while with Preston North End and Sheffield United.
