    Judge orders Warner to turn over financial documents

    PORT OF SPAIN, Trinidad (CMC) — A High Court judge on Thursday ordered the Trinidad & Tobago Football Federation (T&TFF) to have its former special advisor Austin 'Jack' Warner present all "relevant documents" regarding all the finances of the country's participation in the 2006 World Cup.


    In his 11-page ruling, Justice Devindra Rampersad also dismissed an application for Warner, a former FIFA vice-president, to be joined as a defendant in the proceedings brought against the T&TFF by 14 former national players, including former international goalkeeper Shaka Hislop and Stoke City striker Kenwyne Jones.

    In 2007, the players, who represented T&T when the country made its debut appearance at the World Cup in Germany, had filed a claim seeking a number of reliefs, including an account of all sums due from the T&TFF under an agreement made "at a series of meetings" between the representatives of the players and the national governing body.

    They were also seeking an account of all the monies received by Warner and/or former federation president Oliver Camps and general secretary Richard Groden "individually or together, legally or beneficially and/or by to an agent acting on their behalf or any other party under the effective ownership or control of or serving as agents" of the T&TFF, Camps, Warner or Groden.

    The players had also asked the court for a disclosure of all "sums paid" to Camps under the agreement.

    On September 11 last year, the players filed an application for Warner, who is now a senior cabinet minister in the T&T government, to be joined as a party to the proceedings.

    In his affidavit, Warner said that he was prepared to provide to the T&TFF the information or documentation "relevant to the takings of the account between it and the claimants in so far as the same was within his knowledge or control".

    "It is plainly obvious, therefore, that the claimants are not satisfied with this assertion that the information and documentation being provided to the first named defendant (T&TFF) but, instead, they prefer that Mr Warner be made a party to provide an account directly to them through this court in these proceedings," the judge said in his ruling.

    But the judge noted that Warner's attorneys "countered by saying that it is improper for a party to be joined merely for the purpose of disclosure".
    In his ruling, Justice Rampersad, who indicated that "even more remarkable, both Mr Warner and the first defendant have retained the same attorneys-at-law to deal with this matter before the court".

    He said that the court "would not join Mr Warner as a defendant in these proceedings as there is no claim for relief made against (him)".
    But he ruled for certain reliefs "bearing in mind Mr Warner's evidence on affidavit that he is willing to produce information and documentation to the accounts".

    Justice Rampersad ruled that the T&TFF should direct Warner in writing and copied to the attorneys for the players "to file an account of all monies received by him" as the T&TFF's agent "in relation to all income, donations, gifts, grants or benefits whatsoever and all expenditure therefrom arising out of the World Cup 2006".

    The judge said that "such account to be verified by affidavit deposed to by Mr Warner exhibiting all relevant documentation and to be filed and served in these proceedings by February 10".

    Justice Rampersad in dismissing the application to have Warner joined to the matter said the court would also hear arguments on costs.

    Instructive?

    Involvement with a business can open one up to this type probe. Questions on whose interest "Jack" provided actions and possibility of corruption and fraud could be asked unless their is 'heading off at the pass' via out of court settlement.

    One of the many lessons - Do not mess around with corporate funds. ...be absolutely sure actions do not...forget actual 'poor decisions'...do not even raise the possibility of actions being open to interpretation of acting in personal interest. There is absolutely no way of hiding 'paper trail' if there is someone or group of persons determined to expose same.

    The 'trail' just sits there! ...it just never goes away and that even if an out of court settlement is joined.

    The tsunami... ...hey it could envelope others in football...including FIFA ...as any exposure of 'records' could end in the public domain and be used in 'other courts' Right

      As you know there is a judgement against the TTFF to pay the squad from 2006 their share of the profits as ascertained by the judgment.

      Monies were paid into the TTFF's accounts but they were immediately paid out to the LOC committee of the WC 2006 and there the money trail ends.

      JW and co. were ostensibly in charge of these accounts... these guys basically used the Federation as a filter to do what they wanted with the monies without being accountable to anyone. The TTFF will say, our books are in order, which they are, and they acknowledge that they owe the players money but they are essentially broke. All the revenue was expended to one external entity and so the expense side of the books are a mystery.

        That may just mean others are also 'marked' for 'comeuppance' by that trail. The trail would not necessarily end with payment into the TTFF's coffers or at a transfer of the funds to another entity or person or entities or persons. The Whys and Wherefores...etc. would have to be answered.

        If you would forgive me being coarse...one cannot legitimately transfer funds belonging to an individual or individuals or some other entity or entities to another party or parties...or for that matter can one receive such funds and apply them to other purposes and then think 'home free' of committing a crime.

        I think what is the key issue on trial here is the strength of determination to pursue justice that reside in the players.

          Karl, I am not too sure what you are suggesting but the players (led by Shaka Hislop and Brent Sancho) have demonstrated determination to pursue "justice" as you say. They HAVE PREVAILED. At issue now is getting paid the settlement. Money needs to be accounted for as the TTFF's coffers are empty and therefore no payment is forthcoming.

          The TTFF's revenue over the last while apparently was not spent by the TTFF but by the LOC of WC 2006. Jack it seems was in charge of these accounts.

          On another side note his son was "let go" by FIFA from his post as Caribbean Development Officer...ha ha ha.. can you believe such a post even existed? I think JW created that position for his son.

          JW is truly a cryptic character... he would like to pass himself off as a philanthropist, an even Robin Hood -like individual... but when you check it he is more like a benevolent Fagin.

          The fact that he had accumulated a fortune before becoming a minister of government he should be incorruptible... at least in theory.

            Good to have had that ruling in their favour...but it is the receipt of payment that closes out/brings a fair end to this most unfortunate series of events.
